Terms of Service & Temporary Motorcycle Custody Agreement

Rider eligibility, the temporary motorcycle custody mechanism, and deposit, damage and insurance terms.

A. Rider eligibility

  • Valid licensing: the rider declares they hold a valid motorcycle licence together with a valid physical International Driving Permit matching the class of the community motorcycle. Presentation and verification are mandatory conditions for receiving the motorcycle.
  • Age and experience: riding requires a minimum age of 21 and proven riding experience.
  • Mandatory protective gear: a certified helmet and closed shoes are legally required. The rider is responsible for the protective gear and accompanying equipment (racks/bags) they received.

B. Temporary custody and permission to use

  • Vehicle status: for the booking period all rights and obligations in the motorcycle pass temporarily to the rider under a power of attorney / dedicated use agreement. This private agreement does not alter a statutory registration or any liability that cannot be transferred under applicable law.
  • Sole responsibility: from key handover until the vehicle is returned to a company representative at the hub, the rider bears full criminal, civil and traffic liability for every action, traffic report, fine or damage caused by or to the vehicle.
  • No transfer: custody and use of the vehicle are personal to the registered rider only. Transferring, lending or subletting the vehicle to a third party is strictly prohibited.

C. Security deposit, damages and insurance

  • Deposit amount: handover of the motorcycle is conditional on a security deposit of 25% of the motorcycle component of the booking. The deposit is charged in addition to the platform access fee, is not an advance payment, and is not offset against the platform access fee or any other payment.
  • Collection method: the deposit is charged or held on a credit card in the rider's name as a precondition to every custody handover. The rider authorises the company to charge that payment method for any amount the rider owes under these terms, including damages, fines, traffic reports, towing, missing fuel and unreturned equipment.
  • Deposit release: the deposit, or its balance after lawful set-off, is released automatically when the 7-day objection window ends, provided no damage claim or objection is open. A written breakdown of every deduction is provided to the rider.
  • Allocation of damage liability: reasonable wear and tear of the engine, gearbox, frame, tyres, brakes and electrical system, and any mechanical failure or latent defect not arising from unreasonable use, are borne by the motorcycle owner — not by the rider or Kanta Adventure Club. Damage caused by an accident, negligence, use contrary to these terms, riding under the influence, or any act or omission of the rider or a third party on the rider's behalf is borne entirely by the rider, is set off against the deposit, and to the extent it exceeds the deposit the rider remains liable for the balance.
  • Right of objection: a charge beyond the deposit is made only after the workshop inspection report has been provided to the rider and 7 days have passed in which the rider may object in writing. If an objection is filed, the charge is made only after it has been reviewed.
  • Liability cap: the handover document states one fixed and explicit maximum liability amount. To the maximum extent permitted by applicable law and subject to any mandatory provision that cannot be excluded, the rider's aggregate liability for the motorcycle will not exceed that amount, excluding fines and traffic penalties and excluding wilful use or use in express breach of these terms.
  • Kanta's role: Kanta Adventure Club acts only as the platform and operational coordinator for handover, return, documentation and collection. Kanta is not the manufacturer, owner, insurer, garage or supplier of the motorcycle and is not responsible for its roadworthiness, maintenance, wear and tear, mechanical failure or latent defect. To the maximum extent permitted by law, Kanta is not liable for indirect, consequential or special loss, loss of income or third-party claims; nothing excludes liability that cannot lawfully be limited.
  • Personal insurance: the company provides operational support only. The rider must hold valid personal travel insurance including a motorcycling and evacuation extension. The absence of such insurance does not transfer any liability to the company.

Privacy and data protection policy

What data Kanta collects, how it is used, Form C reporting to Indian immigration, and how data is secured.

1. What we collect

  • Identity and contact details: name, phone, email, nationality.
  • Document details required for check-in: passport number, visa type and number, entry dates.
  • Driving licence and IDP details for temporary custody of a community motorcycle.
  • Booking, payment, cafe tab and stay history.
  • Technical website usage data for security and service improvement.

Full card details are never stored on Kanta servers; processing is handled by an external payment provider.

2. Form C and immigration reporting

Indian law requires every accommodation provider to report foreign guests to the immigration authority (FRRO) via Form C, generally within 24 hours of check-in. For that purpose we transmit the guest's name, passport and visa data, stay dates and the hub address.

This transfer is a legal obligation and is not consent-based. Declining to provide the data prevents check-in of a foreign guest.

3. Use and sharing

  • Managing bookings, stays, motorcycle custody, tours and payments.
  • Meeting reporting, tax and insurance obligations.
  • Operational contact by WhatsApp, email or phone regarding your booking.
  • Marketing messages — only with explicit consent and with opt-out at any time.
  • We do not sell personal data to third parties.

4. Security and retention

  • Access is restricted by role (RBAC) and every access is logged.
  • Data is encrypted in transit (TLS) and stored on managed servers with row-level access control.
  • Identity documents are retained for the period required by Indian law and then deleted.
  • Financial records are retained per accounting obligations.

5. Your rights and contact

You may request access to your personal data, its correction, its deletion (subject to statutory retention) or removal from mailings through the contact form on our website. We respond within 30 days.

Temporary custody agreement (handover and return)

The full text displayed and digitally signed at every motorcycle handover and return, including the 25% security deposit charged in addition to the platform access fee.

Handover clauses

  1. I take temporary custody of the motorcycle described above and confirm that I inspected it together with the attached photo record.
  2. For the period stated in the booking, all rights and obligations in the motorcycle pass to me temporarily — possession, use, and full civil, criminal and traffic liability. They revert under the return document when that period ends. This private agreement does not purport to alter a statutory registration or any liability that cannot be transferred under applicable law.
  3. Kanta Adventure Club acts only as the platform coordinating handover, return, documentation and collection, and as the operational reporting contact. Kanta is not the motorcycle owner, insurer or garage and is not responsible for its roadworthiness, maintenance or defects.
  4. I confirm I hold a valid motorcycle licence and a valid International Driving Permit, will wear a certified helmet and closed shoes, and will not hand the bike to a rider not named on the booking.
  5. Transferring, lending, renting or handing the motorcycle to any third party, and taking it outside the country without Kanta's written approval, are strictly prohibited.
  6. The registration certificate (RC), insurance and pollution-under-control (PUC) certificate accompany the motorcycle throughout the custody period; I am responsible for keeping them with the vehicle and presenting them to any authorised official.
  7. I am liable for any damage caused by an accident, negligence, use contrary to the custody terms or an act of a third party on my behalf, as well as for theft, fines, citations and traffic offences during the custody period — including those received after the return for that period.
  8. Riding under the influence of alcohol or drugs, racing, and riding on terrain unsuited to this vehicle are prohibited. Any breach voids all coverage and places the full damage on me.
  9. In any accident, third-party injury or theft I will notify Kanta and the local police immediately; filing a police report is a condition for handling the event.
  10. I will return the motorcycle at the time and place set in the booking, with the fuel level as delivered and all accompanying equipment. A late return is charged as an additional custody day at list price.
  11. Towing, recovery and transport costs arising from a fault or event for which I am responsible are borne entirely by me.
  12. Reasonable wear and tear of the engine, gearbox, frame, tyres, brakes and electrical system, and any mechanical failure or latent defect not arising from unreasonable use on my part, are not my responsibility as rider. Responsibility and repair cost rest with the motorcycle owner; Kanta Adventure Club only coordinates operational handling and neither assumes nor funds them.
  13. I have placed a security deposit of 25% of the motorcycle component of the booking. The deposit is charged in addition to the platform access fee; it is not an advance payment and is not offset against it.
  14. On return the motorcycle is inspected by an independent workshop coordinated by Kanta; that report is the basis for any set-off against the deposit or its release, but Kanta is not responsible for the workshop's work or findings. I authorise Kanta to charge my payment method for any amount I owe beyond the deposit, after the inspection report is provided to me and after 7 days in which I may object to it in writing.
  15. To the maximum extent permitted by applicable law and subject to any mandatory provision that cannot be excluded, my aggregate liability for the motorcycle will not exceed the maximum liability amount stated in the handover document, except for fines, traffic citations and wilful misuse or express breach of the custody terms.

Return clauses

  1. I return the motorcycle to Kanta Adventure Club and confirm the photo record and readings above reflect its condition at the moment of return.
  2. I understand the motorcycle will undergo a mechanic inspection, and that its outcome determines any damage charge or the release of the deposit.
  3. Any charge beyond the deposit will be provided to me in a written report, and I may object to it in writing within 7 days before it is charged.
  4. Fines, citations and traffic offences from the custody period remain my responsibility after the return.

Bike Partner Agreement — temporary partnership in the motorcycle's rights

  1. Platform access revenue split: 75% to the bike host, 25% to the Kanta Adventure Club platform.
  2. The term is 12 months, with an option to extend for one additional year by mutual consent.
  3. The platform requires every rider to declare and upload a valid motorcycle licence and International Driving Permit and blocks handover until operational review is complete; this is not a representation or guarantee by Kanta Adventure Club as to document authenticity or rider conduct. Kanta collects and administers the deposit solely as a payment service.
  4. The motorcycle enters the active fleet only after valid RC and insurance documents are approved.
  5. The motorcycle owner is solely responsible for the validity and cost of registration (RC), insurance and the pollution-under-control (PUC) certificate, including every fee and premium. Kanta Adventure Club may coordinate reminders or renewal solely as an operational service; every cost is deducted from the owner's payout and no responsibility or liability transfers to Kanta.
  6. The motorcycle owner is solely responsible for roadworthiness, preventive maintenance and every service, repair or part cost arising from reasonable wear and tear, mechanical failure, latent defect, or any fault in the engine, gearbox, frame, tyres, brakes, electrical system or other component. Kanta Adventure Club only coordinates the garage and follow-up, does not fund these costs and is not liable for them.
  7. Temporary custody model: legal ownership stays with the owner, and for each booking only custody passes to the rider under a dedicated power of attorney / use agreement. Throughout that period the rider carries full civil, criminal and traffic liability, including every authority charge — all of which is lifted from the owner.
  8. Deposit and damage recovery: Kanta Adventure Club takes a security deposit of 25% of the motorcycle component price from the rider, charged in addition to the booking payment and not as an advance. If rider-liable damage exceeds the deposit, the rider authorises Kanta Adventure Club in advance to charge the payment method on file for the full remaining balance per the workshop inspection report.
  9. Bilateral termination: either party — the bike owner or Kanta Adventure Club — may end the engagement at any time and for any reason with 30 days' prior written notice, without cause and without penalty. From the notice date the motorcycle is not offered for new bookings, and every booking confirmed before the notice is honoured until fulfilled. Final settlement is made in the following payout cycle.
  10. Indemnity and defects: the owner indemnifies Kanta Adventure Club against every claim, debt, fine, loss or demand arising from ownership, registration, insurance, lack of roadworthiness, wear and tear, mechanical failure, latent defect, manufacturing fault or structural failure — including one discovered only during the term — except loss finally adjudged to have resulted from Kanta Adventure Club's direct negligence.
  11. GPS tracking: every motorcycle is fitted with a GPS tracker installed and operated by Kanta Adventure Club — for theft protection, real-time location and accurate mileage reporting. The device cost and its monthly service fee are borne by the bike owner and shown as a separate line in the monthly revenue statement.
  12. Local jurisdiction: this agreement is governed by Indian law, and any dispute arising from it is subject exclusively to the competent courts of Delhi, India.
  13. Tax compliance / TDS: the 75% net payout to the bike owner is subject to Tax Deducted at Source (TDS) and any other statutory withholding mandated by Indian tax laws, where applicable. Any amount withheld is shown separately in the monthly statement and a TDS certificate is issued for it.
